In-home construction agreements are common, but if they are not handled correctly, they can lead to legal consequences for both homeowners and contractors. The Home Solicitation Sales Act (HSSA) creates strict requirements for residential work agreements signed in a customer’s home, and even small mistakes can make a contract unenforceable.
At Hoover Kacyon, LLC, we help both contractors and homeowners understand and comply with the HSSA. Whether you are a business looking to protect your right to payment or a homeowner concerned about a contract or workmanship, we guide you through the legal steps needed to protect your rights and your finances.
What Is theHome Solicitation Sales Act?
The HSSA is an Ohio consumer protection law that applies when a contractor or seller meets with a homeowner at their residence and a contract is signed there. This applies to most home improvement, renovation, and repair contracts entered into in the home.
The HSSA requires that the contractor:
Uses a written contract signed by both parties
Includes a clear cancellation clause allowing the customer to cancel within three business days
Provides a separate written notice of the right to cancel
Gives two copies of that notice to the consumer
Does not start work or collect payment until after the cancellation period (with narrow exceptions)
If these requirements are not followed exactly, the agreement may be considered void, even if the work was completed and accepted. That is why compliance is critical and why homeowners need to understand their rights as well.

FrequentlyAsked Questions
Does the HSSA apply if the homeowner invited the contractor?
Yes. It does not matter who initiated the meeting. If the contract was signed in the customer’s home, the law generally applies.
Can a contractor take a deposit on the same day as signing?
Usually not. Unless a specific exception applies, work and payment must wait until the cancellation period ends. We help structure contracts to avoid violations.
What happens if the cancellation notice is missing?
The homeowner may have the right to cancel the contract indefinitely. We help both parties understand what rights and remedies apply in this situation.
Can payment still be recovered after the job is done?
Possibly. We evaluate the details of the agreement and the project to determine if recovery is possible despite a technical violation.
How do I fix my contract or respond to one I received?
We prepare corrected documents for contractors or review contracts for homeowners to clarify obligations and ensure your legal position is strong.
