Probate is the legal process in which an estate is settled. A probate lawyer is an attorney who assists the executor of a will or the beneficiaries of a deceased person’s estate in settling the estate. A probate lawyer can even be designated as the executor or administrator of an estate.
In Ohio, the probate process timeline typically follows these steps:
1.
The person named as the executor of the will takes charge of administering the terms of the will. If the person named as executor is unwilling or unable to serve as an executor, or if no will exists, a court will appoint an administrator. Nearly always, a surviving spouse is considered first as being appointed administrator.
2. The court will issue a “Letter of Authority” granting the administrator or executor authority to manage the estate.
3. The executor/administrator will then need to:
- Provide proof that the deceased person’s will is valid
- Take inventory of and protect the deceased person’s assets
- Have an appraisal of the assets conducted
- Pay all debts and taxes owed by the deceased person from any estate proceeds
- Distribute property as directed by the will, or if no will exists at the direction of the court
- Keep detailed records of all estate transactions
The death of a loved one can often be an emotional and stressful time. Even simple probate proceedings can take up to nine months to settle. It can take even longer if:
- it is a larger estate
- federal taxes are owed
- another party contests the validity of the will
A probate attorney can assist an executor or administrator with ensuring that settling the estate is carried out properly.
